CPI agrees to evaluate prosecutor Karim Khan’s recusal in Maduro’s trial due to possible conflict of interest
The International Criminal Court (ICC) took a significant step by accepting the recusal request against prosecutor Karim Khanwho leads the investigation into the alleged crimes against humanity committed by the government of Nicolás Maduro in Venezuela.
This action, promoted by the Arcadia Foundation, opens the possibility of reviewing whether there are conflicts of interest that could compromise the impartiality of the prosecutor in this case.
The Arcadia Foundation argues that the possible conflict lies in the family bond between Khan and Venkateswari Alagendra, the prosecutor’s sister-in-law and Maduro’s defense lawyer before the ICC. According to Robert Carmona-Borjas, co-founder of the organization, the appearance of bias is enough to sow doubts about confidence in the judicial process.
«The mere appearance of bias is enough to undermine the trust of the public, victims and the international community in the ICC«Carmona-Borjas stressed.
On the other hand, the Organization of American States (OAS) supported Khan’s integrity, stating that there are no concrete reasons to doubt his professional ethics. Despite this, the ICC decided to proceed with the evaluation of the application presented and recognized the relevance of transparency in its processes.
Efforts to challenge ICC prosecutor Karim Khan
Luis Moreno Ocampo, who was the first Prosecutor of the ICC between 2002 and 2013, emphasized in an interview with NTN24 that the ongoing investigation is important. However, it is not the only tool to confront the crisis in Venezuela.
Moreno Ocampo stressed the need for the Venezuelan opposition to work on democratic transition strategies together with María Corina Machado, beyond judicial actions.
The ICC’s acceptance of the request sets an important precedent for international justice. This highlights that accountability and citizen oversight are essential to guarantee the integrity of judicial processes.
