In the second week of November 2024, a TikTok video is shared on Whatsapp, showing a session of the National Assembly without original audio, but the voice-over says: «Today the Nicolás Maduro regime has just approved one of the most brutalities never seen on our continent, which has unusually nicknamed the law against fascism. The information is misleading.

For anyone who watches the video and is not properly informed about the Venezuelan legislative dynamics, they can give credence to the content of the video that runs on WhatsApp. Although the draft Law against Fascism, Neofascism and Similar Expressions is on the agenda of the National Assembly, as of November 2024 It does not have the final approval that allows it to be promulgated and therefore come into force after its publication in Official Gazette.
In the video you can see two account names on TikTok. That of @lisbaldomartinez on TikTok Lite, which was eliminated, and that of the Colombian influencer @rafaelnavarro1956 on TikTok. When searching on that platform, we found that the video shared by @rafaelnavarro1956 is dated May 7, 2024, which shows that it is not recent.
Furthermore, the bill against fascism was brought to the National Assembly and approved in first discussion on April 2, 2024 and as of November 14, the date of publication of this note, it is still waiting for the second discussion.
«Attention, urgent. Later he mentions article 4, according to which “neoliberal and conservative thinking is prohibited throughout the country.” But the project was never disseminated by the Executive Branch, which was the proponent, nor by the Legislative Branch. However, according to the bill that transcendedin that article the definitions of fascism, neofascism and similar expressions are established.
In the video it is said that articles 12 to 18 are macabre, among the 30 included in the bill. However, it is unknown if the instrument presented to the plenary session was approved without modifications.
Seven months have passed since the AN approved the bill in April. It is still waiting for the second discussion for its sanction and then promulgation by the Executive for its entry into force, once it is published in Official Gazette.
It is misleading, then, to say that “today, the regime of Nicolás Maduro has just approved one of the most brutal laws ever seen on our continent, which it has unusually dubbed the law against fascism,” as indicated in the video circulating on Whatsapp and which was uploaded on TikTok in May.
