IACHR granted precautionary measures to journalist Ana Carolina Guaita
The Inter-American Commission on Human Rights (IACHR) granted precautionary measures on Tuesday in favor of Ana Carolina Guaita, journalist from La Patillaconsidering that he is in a serious and urgent situation of risk of irreparable damage to his rights in Venezuela.
In the Resolution 58/2024the Commission requests the Venezuelan State to adopt the necessary measures to protect the journalist’s rights to life and personal integrity.
“In particular, please report whether the beneficiary is in the custody of the State and the circumstances of his or her detention, or the measures taken to determine his or her whereabouts or fate. The Commission considers it necessary for the State to specify whether the beneficiary was brought before a competent court to review his or her detention if he or she has been charged with crimes. If not, please specify the reasons why he or she has not been released to date,” the document says.
In addition, she requests that the necessary measures be implemented so that Ana Carolina Guaita can carry out her journalistic activities “without being subjected to threats, harassment or acts of violence.” She also requests that to report on the actions taken to investigate the alleged events that gave rise to this precautionary measure “and thus avoid its repetition.”
“The Commission requests that Venezuela provide details, within 15 days from the date of notification of this resolution, on the adoption of the required precautionary measures and update said information periodically,” it added.
The granting of the precautionary measure and its adoption by the State do not constitute a prejudgment regarding a possible petition before the inter-American system in which violations of the rights protected in the American Convention and other applicable instruments are alleged.
The IACHR is a principal and autonomous body of the Organization of American States (OAS), whose mandate arises from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has the mandate to promote respect for human rights in the region and to act as a consultative body to the OAS in this area. The IACHR is composed of seven independent members who are elected by the OAS General Assembly in an individual capacity, and who do not represent their countries of origin or residence.
